End User License Agreement

1. Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you and WatchSafe for the use of the WatchSafe mobile application, web application, and related services (collectively, the "Software").

By downloading, installing, accessing, or using the Software, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not download, install, access, or use the Software.

2. License Grant

2.1 Grant of License

Subject to your compliance with this EULA, WatchSafe grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the Software on your personal devices
  • Use the Software for your personal, non-commercial use
  • Access the Service through the Software

2.2 License Restrictions

You may NOT:

  • Copy, modify, or distribute the Software
  • Reverse engineer, decompile, or disassemble the Software
  • Remove any copyright or proprietary notices
  • Use the Software for commercial purposes
  • Rent, lease, or sublicense the Software
  • Use the Software in violation of any applicable laws

3. Account Requirements

3.1 Age Requirement

You must be at least 18 years old to create a parent account and use the Software.

3.2 Account Responsibility

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use
  • You may not share your account with others

4. Subscription and Payment

4.1 Subscription Required

The Software requires an active subscription to access full features. Subscription plans are available at watchsafe.app/pricing.

4.2 Payment Terms

  • Subscriptions are billed upfront
  • You can cancel at any time
  • Cancellation takes effect at the end of the billing period
  • Refunds are available within 7 days of initial purchase (see Refund Policy)

4.3 App Store Purchases

If you purchase through the Apple App Store or Google Play:

  • Payment is processed by Apple/Google
  • Subscriptions are managed through your App Store or Google Play account
  • Refunds are subject to App Store or Google Play policies

5. Updates and Modifications

WatchSafe may:

  • Update the Software from time to time
  • Add or remove features
  • Modify functionality
  • Require updates to continue using the Software

You agree to install updates as they become available.

6. Third-Party Services

The Software integrates with third-party services, including:

  • YouTube (subject to YouTube's Terms of Service)
  • Google (subject to Google's Terms of Service)
  • Payment processors

WatchSafe is not responsible for third-party services or their terms.

7. Privacy

Your use of the Software is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using the Software, you consent to our Privacy Policy.

8. Intellectual Property

The Software and all related content are owned by WatchSafe and protected by copyright, trademark, and other intellectual property laws. This EULA does not grant you any ownership rights.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WATCHSAFE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SOFTWARE.

11. Termination

11.1 Termination by You

You may stop using the Software at any time by:

  • Canceling your subscription
  • Uninstalling the Software
  • Deleting your account

11.2 Termination by WatchSafe

WatchSafe may terminate your license if you:

  • Violate this EULA
  • Fail to pay subscription fees
  • Engage in fraudulent or illegal activity
  • Abuse the Software or Service

12. Export Restrictions

You may not export or re-export the Software in violation of any applicable export laws or regulations.

13. Governing Law

This EULA is governed by the laws of South Dakota, United States, without regard to conflict of law principles.

15. Entire Agreement

This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and WatchSafe regarding the Software.

By using the Software, you acknowledge that you have read, understood, and agree to be bound by this EULA.
