WatchSafe Affiliate Program Terms & Conditions

These Affiliate Program Terms & Conditions ("Terms") govern participation in the WatchSafe Affiliate Program ("Program"). By applying to or participating in the Program, you ("Affiliate") agree to be bound by these Terms.

1. Program Purpose

The Program exists to allow approved individuals and organizations to promote WatchSafe to families in a manner consistent with WatchSafe's mission of child protection, parental authority, and responsible digital stewardship. Participation is selective and mission-based. WatchSafe reserves sole discretion over approval, continuation, and termination.

2. Eligibility and Approval

  • Participation is by application and approval only.
  • Approval does not create an employment, agency, partnership, joint venture, or fiduciary relationship.
  • WatchSafe may approve or deny any application for any reason.

3. Promotional Requirements

Affiliates agree to: accurately represent WatchSafe's features and limitations; avoid false, misleading, or exaggerated claims; avoid fear-based, manipulative, or coercive messaging; avoid representing WatchSafe as guaranteeing complete or absolute online safety. Affiliates shall not associate WatchSafe with content, causes, or messaging that materially conflicts with WatchSafe's mission or stated values.

4. Compliance With Laws

Affiliates must comply with all applicable laws, including FTC disclosure requirements, advertising and consumer protection laws, and tax reporting obligations.

5. Commissions

Affiliates earn 30% recurring commission on qualifying subscription revenue directly attributable to their referral link. Commission is calculated on net revenue actually received, excluding refunds, chargebacks, and taxes. Payouts are issued monthly after meeting the minimum payout threshold. Affiliates are responsible for providing valid tax documentation. Earned commissions accrued prior to termination will be paid, unless termination resulted from fraud, material misrepresentation, or illegal conduct.

6. Chargebacks

If a customer's payment on a referred subscription is reversed by the customer's bank or card issuer (a "chargeback" or "dispute"), any commission already paid or approved on that transaction was never actually earned as net revenue and will be reversed. WatchSafe will deduct ("claw back") the corresponding commission amount from the Affiliate's future payouts. If future earnings are insufficient to fully offset a clawback, WatchSafe may apply the shortfall against any pending or future payout, or invoice the Affiliate directly for the outstanding amount. Chargebacks are treated the same as refunds for commission purposes and do not, by themselves, constitute a violation of these Terms; however, an unusual or sustained pattern of chargebacks associated with an Affiliate's referrals may be reviewed under Section 7 (Termination) as a potential indicator of promotional misconduct.

7. Termination

Either party may terminate participation at any time. WatchSafe may terminate immediately for: violation of these Terms; misrepresentation or deceptive promotion; conduct that poses brand, legal, or reputational risk. Termination decisions are final.

8. Intellectual Property

Affiliates may use WatchSafe-provided assets solely for approved promotional purposes. All intellectual property remains the exclusive property of WatchSafe.

9. Confidentiality

Affiliates must maintain confidentiality of all non-public WatchSafe information.

10. Governing Law

These Terms shall be governed by the laws of the state in which WatchSafe is incorporated.

11. Entire Agreement

These Terms constitute the entire agreement between Affiliate and WatchSafe regarding the Program.
